While the judge can exercise some discretion when sentencing someone who has been convicted of a DUI offense, in general, the following penalties apply for a blood alcohol content (BAC) between .08 percent and .099 percent:
First DUI: A $300 fine; six months probation; drug and alcohol assessment, alcohol safety training, and court reporting evaluation required.
Second DUI: A $300-to-$1,200 fine; 12-month license suspension; five days to six months in jail; mandatory attendance at alcohol safety school; one-year installation of ignition interlock device on all cars. A drug and alcohol assessment, alcohol safety training, and a court reporting evaluation are also required.
Third DUI: A $500-to-$5,000 fine; 12-month license suspension; 10 days to two years in prison; one-year installation of ignition interlock device on all motor vehicles. A drug and alcohol assessment and a court reporting evaluation are required.
Fourth DUI: A $500-to-$5,000 fine; 12-month license suspension; 10 days to two years in jail; one-year installation of ignition interlock device on all vehicles. A drug and alcohol assessment and a court reporting evaluation are also required.
High BAC Offenders and DUI Penalties
For a DUI conviction for someone with a blood alcohol content (BAC) between .10 percent and .159 percent, the penalties are as follows:
First DUI: A $500-to-$5,000 fine; 12-month license suspension; mandatory 48-hour imprisonment and up to six months in jail; eligible for an occupational limited license after two-month license suspension. Drug and alcohol assessment, alcohol safety training, and court reporting evaluation are also required.
Second DUI: A $750-to-$5,000 fine; 12-month license suspension; 30 days to six months in jail; one-year installation of ignition interlock device; drug and alcohol assessment, alcohol safety training, and court reporting evaluation also required.
Third DUI: A $1,500-to-$10,000 fine; an 18-month license suspension; 90 days to five years in jail; drug and alcohol assessment, alcohol safety training, and court reporting evaluation also required.
Fourth DUI: A $1,500-to-$10,000 fine; an 18-month license suspension; one to five years in prison; installation of an ignition interlock device for 12 months; drug and alcohol assessment, alcohol safety training, and court reporting evaluation required.
In cases where a person’s BAC is in excess of .16 percent, the penalties increase as well. Additionally, if you have a minor in the car with you at the time of your arrest or if you are involved in an injury or fatal accident, additional penalties may be involved.
